Terms of Service

1. Who provides chatworx

chatworx and the website at chatworx.cc are provided by HexaHub Business Services, registered in Pakistan ("we", "us"). These terms apply to the business that uses chatworx ("you") and everyone it gives access. By using chatworx, you agree to these terms and to our Privacy Policy.

chatworx is available as a cloud service that we run, or as a self-hosted version that you run on your own servers. With the self-hosted version, you control the servers and all data on them, and you connect messaging channels with your own accounts and apps (for example your own Meta app). We only access a self-hosted installation when you give us access, for example for setup or support, and then only on your instructions.

2. Accounts

  • Your plan, its limits and its fees are agreed with us before your account is set up.
  • Your account admins decide who can use the account and what each person can do. You are responsible for everything done through your account.
  • Keep sign-in details private, and tell us straight away if you think someone has misused them.

3. Your data

Your messages, contacts and other content belong to you. You allow us to store and process them only to provide chatworx to you, as described in our Privacy Policy. You are responsible for having a lawful basis to collect and use your end users' data, including any consent the law or a messaging channel requires.

4. How we process your data

When we handle personal data for you, whether in the cloud service or when you give us access to a self-hosted installation, you are the controller and we are your processor. This section is our data processing agreement with you, and it applies automatically. If you need a signed copy, ask through our contact form. We will:

  • process your data only on your instructions, which are these terms and how you use chatworx;
  • make sure our staff who can access it are bound to keep it confidential;
  • protect it with appropriate security measures, as described in our Privacy Policy;
  • use other providers (such as hosting) only when needed, under terms that protect your data at least as well, give you a list of them on request, and tell you before we add or replace one;
  • help you respond to requests from people about their data, and with your own data protection duties where needed;
  • tell you without undue delay if we become aware of a breach involving your data;
  • delete your data within 90 days after your account closes, unless the law requires us to keep it;
  • give you the information you reasonably need to check that we keep these commitments.

5. Messaging channels

When you connect a channel such as WhatsApp, Facebook Messenger or email, you must also follow that provider's terms, including Meta's WhatsApp Business Messaging Policy. Providers may limit or suspend your use of their channel, and we are not responsible for their decisions or their outages.

6. Fair use

You must not use chatworx to:

  • send spam or messages to people who have not agreed to receive them;
  • send unlawful, harmful, deceptive or abusive content;
  • break the law or anyone's rights, including privacy rights;
  • try to access other accounts, test or bypass our security, or disrupt the service;
  • go beyond your plan's limits or resell access without our agreement.

We may suspend an account that breaks these rules, and will tell you why.

7. Availability

We work to keep chatworx running and reliable, but we cannot promise it will always be available or free of errors. We may need to pause the service for maintenance or updates, and we will try to give notice when we can. Unless we agree otherwise in writing, chatworx is provided "as is".

8. Ending your account

You can ask us to close your account at any time through our contact form. We may close an account that seriously or repeatedly breaks these terms. Before your account closes, you can ask us for a copy of your data. We delete your account's data within 90 days after it closes, unless the law requires us to keep it. See our Data Deletion page.

9. Liability

We are not liable for indirect, incidental, special or consequential loss, such as lost profits or data, arising from using chatworx. Nothing in these terms limits liability that the law does not allow us to limit.

10. Governing law

These terms are governed by the laws of Pakistan, and any dispute goes to the courts of Karachi, Sindh, Pakistan.

11. Changes to these terms

We may update these terms as chatworx changes. We will post the new version on this page and update the date at the top. If a change materially affects you, we will tell you before it takes effect. If you keep using chatworx after that, the new terms apply.
